A Sheriff Arrested Me in a Diner Without Knowing Who I Was, Then His Deputy Opened My Wallet and Found My Federal Judge Badge

I’m back on the bench in Atlanta now, hearing cases on the twenty-first floor of the Richard B. Russell Federal Building. I wear my robe. I call the docket. I listen to lawyers argue, and I try my best to decide fairly, the way I always have.

But I’m a different judge than I was before that Tuesday in Pell County.

Now, when a police officer testifies in my courtroom that a defendant was “resisting,” I ask to see the video. When a prosecutor argues that bail should be set at $50,000 for a misdemeanor, I ask what the defendant does for a living and whether he’ll lose his job if he sits in jail for three weeks. When someone files a complaint about the way they were treated by the people sworn to protect them, I read every word.

I keep a small framed photograph on the corner of my desk in chambers. It’s not of me, and it’s not of my swearing-in ceremony or my family.

It’s a picture of a blue spiral notebook from Dollar General with a bent corner, sitting on a booking desk under fluorescent lights. An FBI evidence technician took it the night of the search. Agent Calloway sent me a copy with a note on the back.

“Judge, thought you’d want this. Sometimes the most powerful thing in a room costs a dollar and a quarter. — R.C.”

People still ask me why I didn’t speak up that day in the diner. Why I let Dalton Voss slam those cuffs on my wrists and twist my arm until the bone cracked, when I could have stopped it in five seconds by saying who I was.

I tell them what I told the jury.

The badge in my purse could have protected me. But it couldn’t have protected Hattie Greene, Rufus Tate, or Terrence Holloway’s daughter’s tuition money. It couldn’t have protected a nineteen-year-old waitress whose granddaddy lost his job at the poultry plant, or a young deputy who sat in his truck in the driveway every night because he couldn’t stand to go inside and face his mother.

The only thing that could protect them was the truth, written down, seen, and finally read by someone who would listen.

Dalton Voss told me nobody in his town would hear me scream.

He was wrong. They heard. It just took one quiet woman sitting still in a vinyl booth, one young man with a cheap notebook, and thirty-one letters on yellow legal paper.

And now everybody in Pell County knows that somebody is listening.

THE END..!
